Algeria
Marital status discrimination
In 2012, the CRC expressed concern that in Algeria registration officers and family judges often refuse to register children born out of wedlock although no legal restriction exists concerning the registration of those children. The committee went on to acknowledge that sometimes mothers must seek a court judgment in order to pass on their nationality to their children. In the 2017 UPR cycle, the CRC urged Algeria to ensure that children born to an Algerian mother married to a foreign national can automatically acquire their mother’s nationality as prescribed in the Nationality Code.
