Legal gender discrimination
Egypt amended its Nationality Law in 2004 to remove gender discrimination in transmission of nationality by parents to children. However, Egypt’s civil registration law continues to sanction sex discrimination, as births are expected to be registered by the father. The mother can only register the birth of a child if the father is not available. In 2021, CEDAW recommended that Egypt ensure gender equality by eliminating any obstacles or delays faced by Egyptian women in transferring their nationality to their foreign husbands and children and the registration of their birth.
In 2024, the CRC recommended removing the requirement for the father to be present for the registration of a child.
Promising Practices and Updates
Egypt amended the Nationality Act in 2023, as noted by the CRC, granting children of naturalized mothers the right to acquire Egyptian nationality on an equal footing with those born to naturalized fathers.
