Marital status discrimination
In 2019, CEDAW noted that mothers in Iraq can only confer nationality on children if the marriage has been duly registered. This discriminates against children born out of wedlock, children of Iraqi women who are married to a foreign national and children born of forced marriages to combatants or informal marriages. These children are rendered stateless. In 2019 CERD expressed concern about the requirement to provide paternity documents, which could generate statelessness for children born from rape or to an undocumented or deceased father.
