Legal and administrative obstacles for foreign parents with precarious status

In 2012, the Israeli government claimed in its court documents that it did not have a legal obligation to issue official birth certificates to foreigners, and that it would no longer be doing so as a way of preventing them from claiming the right to stay.

In 2023, Israel reported to the CRC that according to Israeli law, children born to foreigners (and residents of the West Bank) are not entitled to Israeli status, and are not registered in the Population Registry. Therefore, there is no authority to issue them a birth certificate. Instead they are issued a “Notice of Live Birth”.
