Registering minorities and stateless persons as foreigners

Israel has created an apartheid structure which repudiates the citizenship of the Palestinian-Arab community living in the Occupied Palestinian Territories (OPT) and East Jerusalem, gradually rendering them stateless. The CRC (2013) expressed concern about Israel’s ban on granting Israeli citizenship to children born of an Israeli parent and a parent from the OPT. The committee also expressed concern about Israel’s decision to stop processing residency applications for Palestinian children, as well as the arbitrary revocation of residency and identity of those living in East Jerusalem. The CRC urged Israel to repeal all legal provisions which result in the denial of Palestinian children’s right to be registered immediately after birth and acquire a nationality. It also recommended transferring the responsibility of administering the population registry to the Palestinian Authority. The CRC (2024) reiterated previous recommendations on repealing legal provisions. Israel has since entrenched its practices of administrative apartheid.
