Administrative blockage for children of mixed status parents
In 2017, CEDAW noted that in Kenya refugee and stateless women married to Kenyan nationals face obstacles obtaining citizenship and conferring it on their children without administrative barriers. Additionally, when the mother was foreign or undocumented, the father was a Kenyan national, and the parents were unmarried, it was often impossible to obtain a birth certificate or proof of citizenship for the child. In 2024, Kenya reported that it’s in the process of reviewing the Citizenship and Immigration Act (2012) to ensure that all refugee and stateless women married to Kenyan nationals may obtain citizenship and confer it to their children without administrative barriers.
