Legal gender discrimination
In 2017, civil society organizations in Lesotho brought it to the CRC’s attention that Mosotho women in Lesotho were discriminated against because they were not given the same right as Mosotho men to pass on their nationality to their spouses. It was argued that the previous laws regarding transmission of citizenship by marriage created a risk of statelessness for children in the event that the child’s mother passes away and the father is stateless or of unknown nationality, or is a foreigner who cannot pass on his nationality to his child.
Promising Practices
In 2018, Lesotho reformed its constitution to create gender equality in transmission of citizenship by marriage.
