Legal and administrative obstacles for foreign parents with precarious status

In Peru, undocumented migrant parents face barriers to registering their children due to documentary requirements. An alien card, passport, or identity card is required to obtain a birth certificate for a minor. CEDAW (2022) and the CRC (2025) expressed concern about the requirement for parents to present identity documents to obtain birth certificates for their children, which CEDAW noted may result in statelessness of children born to undocumented parents given the large number of migrant, refugee and asylum-seekers in the State party. Both Committees recommended removing parental documentation requirements to obtain a birth certificate for a child.
