Legal gender discrimination
In 2012, CERD recognized the intersection of racial discrimination and discrimination against non-citizens in Senegal. The committee recommended that Senegal speed up its revision of the Nationality Code to ensure that Senegalese women married to foreigners may pass their nationality on to their children or their husbands in the same way that Senegalese men can. While this reform did proceed, in 2023 CERD expressed concern about difficulties registering births and obtaining citizenship for children of unknown parentage or to parents who are undocumented/have no documents to prove nationality.
Promising Practices
In 2013, the Human Rights Council recognized that Senegal amended its Nationality Code. This ended the discriminatory treatment against women in terms of transmitting Senegalese nationality through marriage, descent, or adoption. In 2023, CERD welcomed the amendment to the Nationality Code.
